1. Scope
These General Terms and Conditions apply to all orders and purchases made through the online shop on this website.
The online shop is operated and all purchase contracts are concluded exclusively with:

Concrete Current GmbH operates the online shop under licence from Surf Club München e.V.
Surf Club München e.V. is responsible for club content, memberships, club communications and club-related information on this website. Membership applications, the Club Statutes, the Membership Fee Schedule and club-related matters concern Surf Club München e.V. exclusively and do not form part of these shop Terms and Conditions unless expressly stated otherwise.
2. Contracting party
For every purchase in the online shop, a contract is concluded exclusively between the customer and Concrete Current GmbH.
Surf Club München e.V. does not become a contracting party through a purchase in the online shop unless expressly stated otherwise for a specific offer.
3. Offers and products
The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order.
Product images, colours and representations may differ slightly from the actual product depending on the screen, device or display. The respective product descriptions in the online shop are authoritative.
Concrete Current GmbH reserves the right to modify or discontinue products, collections, collaborations or limited drops at any time or to offer them only in limited quantities.
4. Ordering and conclusion of the contract
The customer can select products and place them in the shopping cart. Before completing the order, the customer can review and amend the information provided.
By clicking the order button, the customer submits a binding offer to purchase the products contained in the shopping cart.
The contract is concluded when Concrete Current GmbH accepts the order, in particular by sending an order confirmation by email or by dispatching the goods.
5. Prices and payment
All prices are stated in euros and include statutory VAT where applicable.
Shipping costs may apply in addition and are shown to the customer before the order is completed.
The available payment methods are shown at checkout. Payments may be processed through Shopify and connected payment service providers.
The customer is obliged to provide complete and accurate payment, billing and delivery information.
6. Delivery and shipping
Delivery is made to the delivery address specified by the customer.
Delivery times, shipping methods and shipping costs are stated in the online shop or at checkout.
For consumers, the risk of accidental loss of or accidental damage to the goods passes only when the goods are handed over to the customer or an authorised recipient. This is relevant because the general shipping-risk rule in Section 447 of the German Civil Code is restricted for consumer-goods purchases by Section 475(2) of the German Civil Code.
If a product is unavailable, the customer will be informed. Payments already made will be refunded unless a substitute delivery is agreed.
7. Retention of title
The goods remain the property of Concrete Current GmbH until payment has been made in full.
8. Consumers’ right of withdrawal
Consumers generally have a statutory right of withdrawal for distance contracts. This right arises from Section 312g in conjunction with Section 355 of the German Civil Code; the withdrawal period is generally 14 days.

The right of withdrawal does not apply, or may be excluded, where statutory exceptions apply, for example for certain custom-made or personalised goods. The statutory provisions and the respective withdrawal policy are authoritative.
9. Returns and refunds
Information on returns, refunds and return shipments is provided in the separate Shipping & Returns policy.
The customer’s statutory rights remain unaffected.
10. Liability for defects
Statutory rights relating to defects apply.
If a delivered product is defective or damaged, the customer may contact the shop address stated in the legal notice or on the contact page.
11. Liability
Concrete Current GmbH has unlimited liability in cases of intent and gross negligence and for injury to life, body or health.
In cases of ordinary negligence, Concrete Current GmbH is liable only for breach of material contractual obligations. Material contractual obligations are obligations whose fulfilment makes the proper performance of the contract possible in the first place and on whose fulfilment the customer may regularly rely. In such cases, liability is limited to foreseeable damage typical of the contract.
Liability under the German Product Liability Act remains unaffected.
12. Content, trademarks and licence
Content, trademarks, texts, images, designs, logos, photographs, videos and other materials used on this website may be protected by copyright, trademark law or other rights.
Concrete Current GmbH uses the name, trademark and certain content of Surf Club München e.V. within the online shop under licence.
Use, reproduction, editing or further use of the content without prior consent is not permitted.
13. Club content and membership
Information about the club, membership, the Club Statutes, the Membership Fee Schedule or club activities is provided for information about Surf Club München e.V.
Where a membership application is submitted through this website, the application is addressed to Surf Club München e.V. and not to Concrete Current GmbH unless expressly stated otherwise.
Membership is accepted in accordance with the rules of Surf Club München e.V., in particular its Club Statutes and Membership Fee Schedule.
Memberships are not regular contracts for the purchase of goods through the online shop unless expressly designated as a separate paid offer subject to its own conditions.
14. Data protection
Information on the processing of personal data is provided in the separate Privacy Policy.
Concrete Current GmbH is responsible where personal data is processed in connection with orders, payments, shipping, returns or shop communications.
Surf Club München e.V. may be responsible where personal data is processed in connection with club memberships, membership applications or club-related communications. The precise allocation of responsibility is set out in the Privacy Policy.
15. Use of the website
The website and online shop may be used only in a lawful manner.
In particular, any use that violates applicable law, infringes third-party rights, disrupts technical systems, circumvents security mechanisms or extracts content automatically in an unauthorised manner is prohibited.
16. External links and third-party services
This website may contain links to external websites or third-party services.
Concrete Current GmbH is not responsible for the content, privacy practices or services of external providers unless such content or services are expressly operated or controlled by it.
17. Shopify
The online shop is technically operated through Shopify.
Shopify provides the technical infrastructure but is not a contracting party for purchases made in the online shop. All purchases are made exclusively between the customer and Concrete Current GmbH.
Further information about the processing of personal data in connection with Shopify is provided in the Privacy Policy.
18. Dispute resolution
Concrete Current GmbH is neither obliged nor willing to participate in dispute-resolution proceedings before a consumer arbitration board unless required by law.
The former EU online dispute-resolution platform was discontinued on 20 July 2025; the previous obligation to link to that platform therefore no longer applies. General information obligations under the German Consumer Dispute Resolution Act may nevertheless remain relevant.
19. Applicable law
German law applies, excluding the United Nations Convention on Contracts for the International Sale of Goods.
For consumers, this choice of law applies only insofar as it does not deprive them of mandatory consumer-protection provisions of the country in which they have their habitual residence.
20. Amendments to these Terms and Conditions
Concrete Current GmbH may amend these Terms and Conditions where required due to changes in legislation, technical changes or changes to the business model.
The version valid at the time of the order applies to that order.
21. Final provisions
If individual provisions of these Terms and Conditions are or become invalid, the validity of the remaining provisions remains unaffected.
